GMS Cruise Rental Agreement & Terms & Conditions

Rental Agreement

Gold Mobility Scooters LLC., operating as GMS Cruise, rents mobility scooters, wheelchairs, walkers, strollers and related mobility equipment (hereinafter referred to as the "Equipment") to the individual signing this agreement (the "Renter").

By completing a reservation, the Renter agrees to all terms and conditions contained herein.

All Equipment remains the sole property of Gold Mobility Scooters LLC. and is delivered in clean, safe and fully operational condition. The Equipment must be returned in the same condition, excluding normal wear and tear, at the agreed return location and time.


Equipment Availability

All rentals are subject to availability.

Specific models, colors, or configurations are considered preferences only. Should the reserved model become unavailable due to maintenance or operational requirements, GMS Cruise reserves the right to provide an equivalent or upgraded model at no additional cost.


Cruise Terminal Delivery

The renter is responsible for providing accurate cruise information, including:

  • Cruise Line
  • Ship Name
  • Sailing Date
  • Cruise Terminal

The renter must arrive at the designated meeting location at the agreed delivery time.

Failure to provide accurate information may delay delivery and does not qualify for a refund.

GMS Cruise Return & Lost Equipment Policy

All rented equipment must be returned to the designated GMS Cruise pick-up/return service area. Our approved return service area includes:

  • Cocoa Beach
  • Cape Canaveral
  • Port Canaveral

Equipment must be available for pickup at one of the locations listed above on the scheduled return date and time.

If any equipment is left on a cruise ship, at a different port, at an airport, hotel, private residence, or at any location outside of the approved GMS Cruise service area, the renter will be held fully responsible for the equipment.

Any equipment that is lost, abandoned, not returned, or left in a location where GMS cannot retrieve it will result in a charge for the full replacement value of the equipment, including any accessories provided with the rental (such as chargers, baskets, canopies, holders, or other add-ons).

 

Off-Road & Improper Use Policy

All GMS Cruise equipment is intended for use only on solid, stable, and paved surfaces, including sidewalks, roadways, cruise terminals, and other hard, level surfaces.

The equipment must not be operated on or through:

  • Sand or beaches
  • Mud
  • Dirt or unpaved trails
  • Gravel or loose rock
  • Large rocks or rough terrain
  • Standing water or flooded areas
  • Ect...

If the equipment becomes stuck, tipped over, submerged, damaged, or requires recovery due to being operated on any prohibited surface, the renter accepts full responsibility for all resulting damages, recovery fees, repair costs, transportation costs, and, if necessary, the full replacement value of the equipment.

Any damage caused by misuse, negligence, or operation on prohibited terrain is not considered normal wear and tear and will be billed to the renter accordingly.

 

Missed Delivery

The renter must be present at the agreed delivery location and time.

If the renter fails to collect the Equipment before boarding the cruise ship, the rental will be considered a no-show.

Due to the nature of cruise departures, GMS Cruise is unable to reschedule deliveries once the vessel has departed.

No refund or credit will be issued.


Equipment Return

The renter is responsible for returning all Equipment and accessories to the agreed pickup location upon disembarkation.

Failure to return the Equipment on time may result in:

  • Additional rental charges
  • Recovery fees
  • Transportation costs
  • Storage fees
  • Replacement charges if necessary


Equipment Left Onboard

The renter is solely responsible for ensuring that all rented Equipment and accessories are removed from the cruise ship upon disembarkation.

If Equipment is left onboard, the renter shall be responsible for all costs associated with recovering the Equipment, including shipping, transportation, administrative fees, storage charges and any costs imposed by the cruise line or port authority.

If the Equipment cannot be recovered, the renter agrees to pay the full replacement value.


Cruise Delays & Schedule Changes

GMS Cruise shall not be responsible for itinerary changes, delayed embarkation, delayed disembarkation, weather events, customs delays, port closures, missed ports, or any circumstances beyond our control.

If your cruise schedule changes, you should notify GMS Cruise immediately.


Boarding Responsibility

The renter is solely responsible for allowing sufficient time to collect the Equipment before boarding.

GMS Cruise shall not be liable for missed embarkation, boarding delays, denied boarding, or travel interruptions resulting from the renter arriving late or failing to collect the Equipment before boarding.


Personal Property

Gold Mobility Scooters LLC. shall not be liable for the loss, theft or damage of any personal property stored on, transported by, or left with the Equipment.

The renter assumes all risk relating to such property.


Equipment Condition

The renter acknowledges that all Equipment has been inspected and is in good working condition when delivered.

The renter accepts responsibility for any damage, loss, theft or destruction beyond normal wear and tear and agrees to reimburse GMS Cruise for repair or replacement costs.


Damage & Payment Obligations

The renter agrees to be financially responsible for all damage beyond normal wear and tear.

Invoices must be paid by the stated due date.

Balances not paid by the due date shall accrue a convenience fee of $15 per day until paid in full.

GMS Cruise reserves the right to pursue legal action to recover unpaid balances, attorney's fees, court costs and collection expenses.


Battery Charging & Technical Support

All powered Equipment is delivered fully charged and undergoes a comprehensive inspection, cleaning, safety inspection, and operational test before every rental. Because of these procedures, less than one percent (1%) of our rentals experience any type of mechanical issue, making equipment failures extremely rare.

The renter is responsible for charging the Equipment as needed throughout the rental period. We recommend leaving the Equipment plugged in overnight regardless of the battery indicator. The charger automatically regulates charging; however, it should not remain connected for more than twenty-four (24) consecutive hours.

If the Equipment experiences an issue while onboard the cruise ship, the renter must contact GMS Cruise immediately. Our team will provide troubleshooting assistance by phone and make every reasonable effort to resolve the issue remotely.

Because the Equipment is onboard a cruise ship, repairs, replacements, or exchanges cannot be performed during the voyage.

Once the Equipment has been returned, GMS Cruise will conduct a complete inspection to determine the cause of the reported issue.

If the inspection determines that the malfunction resulted from a defect or mechanical failure for which GMS Cruise is responsible, an appropriate refund or rental credit may be issued at GMS Cruise's sole discretion.

If the inspection determines that no defect existed, or that the issue resulted from improper operation, accidental damage, failure to charge the Equipment, water damage, misuse, or any circumstance outside the control of GMS Cruise, no refund or credit will be issued.


Proper Use of Equipment

The Equipment shall be operated responsibly and in accordance with all applicable laws, cruise line policies and port regulations.

The following are prohibited:

  • Riders under 18 years old
  • Carrying passengers
  • Using a phone while operating the Equipment
  • Reckless or unsafe operation

The renter assumes full responsibility for all injuries or damages arising from the use of the Equipment.


Improper Use & Staff Conduct

GMS Cruise reserves the right to terminate the rental agreement without refund if the renter:

  • Abuses the Equipment
  • Uses the Equipment improperly
  • Behaves in a hostile, threatening or abusive manner toward company staff
  • Attempts to coerce the company by threatening chargebacks or negative reviews in exchange for exceptions to company policy


Damage, Loss & Theft Reporting

The renter shall notify GMS Cruise within two (2) hours of any accident, theft, damage or malfunction involving the Equipment.

The renter remains financially responsible for all damage, loss or theft.


Payment Policy

GMS Cruise accepts Visa, Mastercard, American Express and Discover.

A valid government-issued photo identification may be required upon delivery.

Prepaid cards, gift cards, checks and money orders are not accepted.


Cancellation Policy

  • Cancellations made more than forty-eight (48) hours before the scheduled delivery will receive a full refund.
  • Cancellations made within forty-eight (48) hours of the scheduled delivery will receive a refund less a $50 processing fee.
  • Cancellations made on the scheduled delivery day, after delivery, or failure to collect the Equipment before boarding are non-refundable.
  • Early returns are non-refundable.


Rental Extensions

Rental extensions are subject to Equipment availability.

Requests must be made before the scheduled return date.

Extensions are not guaranteed.


Lost Accessories

The renter is responsible for all accessories provided with the rental, whether complimentary or rented separately.

This includes, but is not limited to:

  • Phone holders
  • Cup holders
  • Oxygen holders
  • Cane holders
  • Canopies
  • Bags
  • Trays
  • Chargers
  • Keys
  • Any other accessory provided during the rental

Lost or damaged accessories will be charged at replacement cost.


Refund Processing

Approved refunds may require up to four (4) business days to be processed by GMS Cruise.

Once processed, the time required for funds to appear in the customer's account depends entirely upon the customer's financial institution.


Group Reservations

When multiple pieces of Equipment are reserved under a single booking, the individual completing the reservation accepts responsibility for informing all users of these Terms & Conditions.

If all users are not present at the time of delivery, separate reservations should be made so each renter may independently review and accept these Terms & Conditions.
